Thank you for visiting Arometry.com. By placing an order, you enter into a legally binding contract. Please read these Terms carefully. By accepting these Terms, you also acknowledge our Shipping, Return, and Privacy Policies.
1. General Information
1.1 Online Shop: Arometry.com offers high-quality fragrance samples exclusively for olfactory evaluation. We do NOT sell full-size original bottles. 1.2 Modifications: We reserve the right to modify these Terms. Changes take effect upon posting. For existing orders, the Terms in place at the time of purchase apply.
2. Affiliation & Authenticity
2.1 No Affiliation: We are not affiliated, associated, or sponsored by any fragrance brands or trademark owners. All names and logos are used solely for identification. 2.2 Authenticity: All scents are decanted from genuine fragrance bottles purchased from authorized retailers. 2.3 Packaging: Samples are hand-filled into neutral, sterile sprayers. Original brand packaging is not included.
3. Use of Samples & Legal Disclaimer
3.1 For Scent Sampling Only: In accordance with EU safety regulations for decanted products, our samples are sold for olfactory exploration only. 3.2 Disclaimer: We do not recommend applying these samples to skin or clothing. Any use beyond olfactory evaluation is at the sole risk of the user. Arometry is not liable for allergic reactions or damages resulting from use contrary to this instruction.
4. Pricing & Payment
4.1 Finality: The price at checkout is final. We reserve the right to change prices for future orders. 4.2 Accuracy: The customer is responsible for providing correct billing and shipping information.
5. Shipping & Delivery
5.1 Delivery Risk: Per EU law, the risk of loss or damage remains with Arometry until the goods are physically possessed by you or a third party designated by you. 5.2 Failed Delivery (Customer Error): If a package is returned to us ("Return to Sender") due to an incorrect/incomplete address or failure to collect from a pickup point:
Original shipping fees are non-refundable.
The actual cost of return shipping charged by the carrier will be deducted from your refund.
Reshipment requires a new shipping fee. 5.3 Delivery Issues: If your order does not arrive, please notify us promptly. While your legal rights are not forfeited by delay, early notification allows us to open a carrier investigation. (Note: The previous 7-day forfeiture clause has been removed to comply with EU Law).
6. Important Information for Customers in Italy
Due to the procedures of Poste Italiane, we strongly recommend using the PostePlus service. If a package is returned to us because the recipient was unreachable or the address was inaccessible, the provisions of Clause 5.2 regarding return shipping costs will apply.
7. Right of Withdrawal (Cancellation Policy)
7.1 14-Day Right: You have the right to withdraw from this contract within 14 days of receiving your goods without giving a reason. 7.2 Hygiene Exception (Critical): Pursuant to Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods which were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons.
We only accept returns for samples that are completely sealed and unused.
If the seal is broken or the sample has been sprayed, the right of withdrawal is forfeited. 7.3 Return Costs: The direct cost of returning the goods is the responsibility of the customer.
8. Damaged or Defective Goods
8.1 Please inspect your order upon arrival. If an item is damaged, contact us with photographic evidence. Your statutory warranty rights under German/EU law remain unaffected.
9. Liability Limitation
9.1 Our liability is limited to the purchase price of the product. We are not liable for incidental damages resulting from improper use (see Clause 3.1).
10. Intellectual Property
10.1 All content, images (including those on Shopify CDN), and text on Arometry.com are our intellectual property. Unauthorized use is prohibited.
11. Governing Law
11.1 These terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protection laws in your country of residence.
